Responding to Office Actions
An office action can either be a refusal, rejection, or a from the United States Patent and Trademark Office. Some office actions are final, however, not all office actions are final and having the appropriate response can be difficult. Hiring an attorney to respond to office actions is highly recommended. Answering an office action on your own without the proper knowledge and guidance can cause serious problems for the likelihood of your trademark receiving registration.
TRADEMARK FAqs
What is a Trademark?
A trademark can be any word, phrase, symbol, design, or a combination of these things that identifies your goods or services. A trademark helps consumers distinguish your products from those of your competitors.
It may be the name of your company, like Google® ;
the name of your product, like iPhone®;
or a graphic design, like the Nike® "swoosh" logo.
Do I have to register my trademark?
No. Using your mark in commerce will allow it to gain "common law" rights. But, these rights are much more limited in scope than the nationwide protection offered by a federally registered trademark.
A trademark:
Identifies the source of your goods or services
Provides legal protection for your brand
Helps you guard against counterfeiting and fraud.
