Trademark Filing: Pre-Filing & Engagement Terms
Required Trademark Information. As a condition to ordering any Trademark Filing Package, you must provide us with (a) the proposed trademark (word, phrase, or logo), (b) a clear description of the goods and/or services with which the trademark is or will be used, and (c) the full legal name and address of the trademark owner. We cannot process your order without this foundational information.
Trademark Intake Form. Prior to checkout, you must complete and submit our Trademark Intake Form in its entirety. Orders submitted without a fully completed form will be placed on hold, and we may cancel the engagement if the required details are not provided within five (5) business days.
Conflict of Interest Check. No substantive work will commence, and no legal engagement will be deemed effective, until we complete and clear a conflicts-of-interest review under the North Carolina Rules of Professional Conduct. If a conflict is identified that precludes our representation, we will notify you promptly and refund any unearned fees.
Service Period. All professional services included in your package, such as the preparation and filing of the application, must be initiated and completed within ninety (90) days of the purchase date. This requires your timely cooperation in providing necessary information and specimens. After this 90-day period, any unused services will expire, and subsequent work will be subject to our standard hourly rates or a new engagement agreement.
Effect of Non-Compliance. Failure to provide the required information, complete the intake form, or clear the conflicts check will delay or prevent the filing of your trademark application. We reserve the right to suspend or terminate your order and retain any fees earned for work performed up to the date of termination, in accordance with our Client Engagement Agreement.
Package fees cover only the legal services expressly listed for the preparation and filing of one trademark application in one class of goods/services. United States Patent and Trademark Office (USPTO) filing fees, comprehensive search fees, statement of use filing fees, responses to USPTO Office Actions, and any opposition, cancellation, or litigation proceedings are not included and will be billed separately. All work is performed pursuant to our standard engagement agreement. Package pricing is subject to change.
